Maine's ISP Privacy Law Does Not Violate the First Amendment, Passes Early Test

At this point, it’s fairly well known that your ISP can monitor and track your web traffic. Typically this information is monetized and used for marketing.

However, in Maine, there is a law that protects internet users from having their information sold without their consent. The law in question requires opt-in consent before any personal data can be used for commercial purposes.

Unsurprisingly, ISPs in Maine were unhappy with this law. A legal attack was filed and the ISPs’ claimed the law was unconstitutional by violating the first amendment. Luckily, a federal judge rejected this attack which is a win for the residents of Maine and privacy advocates likewise.
